We at TargetSpot, Inc. (“TargetSpot,” “we,” “us,” or “our”) created this privacy policy (“Privacy Policy”) because we know that you care about how information you provide to us is used and shared. This Privacy Policy relates to the information collection and use practices of TargetSpot with regard to the information collected through our website located at (the “Site”), as well as the information that we collect from streaming audio and video ads and other ads that are served through our advertising network (the “TargetSpot Ads”). By visiting the Site and/or interacting with any TargetSpot Ad, you agree to the terms of this Privacy Policy.

Third Party Data Collection Practices Not Covered by This Privacy Policy.

This Privacy Policy does not apply to information that may be collected by third parties such as (1) the internet radio and other streaming services in which TargetSpot Ads appear or (2) TargetSpot’s advertiser clients (for example, if you click on a TargetSpot Ad that is displayed on your device when you use a streaming service).

Information We Collect

Personal Information

We do not collect any personal information, such as your first name, last name and email address (“Personal Information”) from you unless you voluntarily provide it to us.

Anonymous Information

When you visit the Site or interact with TargetSpot Ads, we may use automatic data collection technology that records non-personally identifiable information from your browser or device. We also may collect or receive other non-personally identifiable information from the Site, from TargetSpot Ads or from data aggregators, streaming services and other third parties. This information may include information about your operating system, your IP addresses, browser type and language, referring and exit pages and URLs, keywords, date and time, amount of time spent on particular pages, what sections of a website you visit, your use of the Site and interactions with TargetSpot Ads and the streaming services on which the TargetSpot Ads appear, as well as other non-personally identifiable information associated with your IP address or device that is maintained by third party data aggregators (collectively, “Anonymous Information”).


We may collect Anonymous Information by using cookies. Cookies are small packets of data that a web site stores on your computer’s hard drive so that your computer will “remember” information about your visit. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web site users. You can reject cookies by following the directions provided in your Internet provider’s “help” file. If you reject cookies, you may still visit the Site, but may not be able to use some areas of the Site. You will still receive TargetSpot Ads, but in some cases we may not be able to use information to personalize the TargetSpot Ad content for you.

We may also allow third-party companies that are presenting advertisements on the Site to set and access their own cookies. Such third-party cookies are not governed by this Privacy Policy, but by the privacy policies of the third party.

Your Choices Regarding Interest-Based Advertising.

In providing TargetSpot Ads, TargetSpot may use non-personally identifiable information associated with your IP address or device in order to serve ads that are more relevant to you. TargetSpot uses non-personally identifiable information provided by third party data aggregators for this purpose. In some cases, you may be able to control whether not TargetSpot will receive information associated with your IP address or device from these third party data aggregators by going to the Network Advertising Initiative’s (“NAI”) website ( and following the directions there to opt out of interest-based advertising for all of the companies listed on the NAI website. TargetSpot is not responsible for the effectiveness of the NAI’s opt-out mechanism. Please keep in mind that if you opt-out, you will still receive TargetSpot Ads although they may not be tailored to your interests. Also, if you opt-out, information about your usage of online services may still be collected for research, analytics or internal operations purposes.

Because your opt-out choices are not associated with you as a particular individual, but rather with the browser you are using, if you change computers, web browsers or cookie settings, you will need to re-implement your opt-out preferences on the NAI website as described above.

While you may be able to control TargetSpot’s ability to provide interest-based advertising by opting-out from our third party data aggregators as described above, at this time TargetSpot does not itself monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

How We Use Your Information.

Personal Information

We may use your Personal Information in a manner that is consistent with this Privacy Policy and the context of our relationship with you. We will use your Personal Information for the following purposes:

We, like many businesses, sometimes hire other companies to perform certain business-related functions. Examples include mailing information, maintaining databases, hosting services, and processing payments. When we employ another company to perform a function of this nature, we provide them with the information that they need to perform their specific function. We require such third parties to maintain the confidentiality of such information and use such information only as necessary to provide us with designated services.

If we or all or substantially all of our assets are acquired, we expect that the information that we have collected, including personally identifying information, would be transferred along with our other business assets.

We may disclose your Personal Information or Anonymous Information to government authorities, and to other third parties when compelled to do so by government authorities, at our discretion, or otherwise as required by law, including but not limited to in response to court orders and subpoenas. We also may disclose this information when we have reason to believe that someone is or may be causing injury to or interference with our rights or property, other users of this Site, or anyone else that could be harmed by such activities.

Anonymous Information

We may use your Anonymous Information in a manner that is consistent with this Privacy Policy and the context of our relationship with you, including when we provide TargetSpot Ads.

How We Protect Your Information

We take commercially reasonable steps to protect the Personal Information and Anonymous Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet.

Accessing and Modifying Account Information

If you would like to have your Personal Information removed from the Site’s database, please contact us at and we will use reasonable efforts to comply with your request. Keep in mind, however, that there will be residual information that will remain within the Site’s databases, access logs, and other records, which may or may not contain such Personal Information.

Accessing and Modifying Communication Preferences

You may manage your receipt of marketing e-mails from us by clicking on the “unsubscribe” link located on the bottom of any TargetSpot marketing e-mail. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases.


This Site contains content, services, advertising and other materials that link to web sites operated by third parties. We have no control over those other sites, and this Privacy Policy does not apply to them.

Important Notice to Non-U.S. Residents

The Site and its servers, and the servers for TargetSpot’s products and services, are operated in the United States and may be operated elsewhere. Please be aware that your Personal Information and other information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. By using the Site and/or providing us with any information, you consent to this transfer.


We do not knowingly collect Personal Information from children under the age of 13 through the Site or TargetSpot’s products or services. If you are under 13, please do not give us any Personal Information. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children to never provide Personal Information to us without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please contact us, and we will endeavor to delete that information from our databases.

California Residents

Under California Civil Code Section 1798.83, California residents who have an established business relationship with TargetSpot may choose to opt out of our sharing your Personal Information with third parties for direct marketing purposes.
